Dutch Christian Democrats in Favour of Legal Ban on LGBTI Discrimination

The CDA party convention unanimously backed a proposal on the inclusion of an explicit prohibition of LGBTI discrimination in the Constitution. With this, a majority in parliament for such a ban is finally in sight. The COC has urged the CDA (Christen-Democratisch Appèl) to do so, and is extremely happy with the party’s decision.

The proposal was submitted by CDA members Marc Haverkamp, Jan Hutten and Gerben Horst, and will be included in the electoral programme of the CDA for the period 2017-2021. According to the petitioners, in addition to a ban on LHBTI discrimination an explicit ban on discrimination on the grounds of disability should be included in Article 1 of the Constitution. In 2011, D66, PvdA and GroenLinks submitted a similar private member's bill. So far, there was no clear parliamentary majority for this. With the support of the CDA, this majority is now in reach.

Last year, the COC has urged the CDA to include a constitutional ban on LGBTI discrimination in its electoral programme. The interest group has since spoken with the Programme Committee and various members of the party. Haverkamp, Hutten and Horst managed to successfully get the proposal accepted by the party convention.

An explicit constitutional ban on LHBTI discrimination is a top priority for the COC. The interest group wants it to be included in the next coalition agreement. According to the COC, a constitutional prohibition guarantees that recent legal achievements for the LGBTI community cannot simply be dismantled in the near or distant future. Furthermore it sometimes makes discrimination more easily provable in court, while it also gives out a strong signal : LGBTI discrimination is unacceptable.

In the current Article 1 of the Constitution, only religion, philosophy of life, political orientation, race, and gender are explicitly mentioned as prohibited grounds of discrimination.
