Mozambique Strikes Gay Sex Penalty Clause

by our Editors in History & Politics , 15 augustus 2015

As of last June, sex with someone of the same gender is no longer punishable in Mozambique. It is the result of the work of Lambda, a partner organisation of COC Netherlands in Mozambique

The parliament in Mozambique passed the bill in December, and the law is into force now. Mozambique is one of the few countries on the African continent where sex between members of the same sex is not punishable.

Although in recent years very few people were arrested or convicted on same-sex charges in Mozambique, the law change is particularly important in stimulating the conversation on the punishability of homosexuality in neighbouring countries, such as Tanzania and Malawi.

Mozambique still has a long way to go when it comes to social acceptance and equal rights of LGBTs. A recent study shows that health care in Mozambique is poorly accessible to LGBTs. This study was realised with the support of COC Netherlands. Many LGBTs have to deal with discrimination and stigmatisation on a daily basis. For seven years now, the COC partner organisation Lambda has been fighting for the registration of their organisation. At the moment, they are preparing a public campaign to enforce their demand to be able to register.

This year, the human rights situation in Mozambique is evaluated by the Human Rights Council of the UN in Geneva. COC Netherlands is training Lambda activist to raise awareness of the human rights situation of LGBTs in their country.
